1. Acceptance of Terms
These Terms and Conditions govern your use of the CarGate app and its services. By downloading the app, browsing, or creating an account, you agree to be bound by these terms and any future updates we publish. If you do not agree, please stop using the app.
2. Eligibility and Accounts
You must be at least 18 years old to create an account or enter into a transaction. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorized use. Your phone number is verified once by OTP at signup, and you are responsible for all activity under your account.
3. Listings and Content
You may only list vehicles or services that you own or are legally authorized to sell. Listings must be accurate, use real photos of the actual vehicle, and comply with applicable law. We may review, reject, or remove any listing that is misleading, duplicated, prohibited, or in violation of these terms.
4. Buying and Selling
CarGate is a marketplace that connects buyers with sellers, showrooms, and service providers. We are not a party to any transaction and do not own, inspect, or guarantee any vehicle or service listed. Always inspect a vehicle in person, verify its documents and ownership, and meet in safe public locations before paying.
5. Listing Plans, Fees and Payments
Creating an account, browsing, messaging, and posting a car on the free Basic plan are free. Individual sellers may also choose an optional paid promotion plan (for example, Sponsored or VIP) that gives a listing higher visibility and a longer time live; the price and duration are always shown before you pay. Paid plans are processed securely by our payment provider, Wayl (thewayl.com): you complete payment on Wayl's checkout using the method you choose — card, ZainCash, FIB, FastPay, and other supported methods — and your card or wallet details are entered on Wayl and are never seen or stored by CarGate. A paid plan promotes your listing only; it is not a guarantee of a sale. Because promotion begins as soon as your listing is published, paid-plan fees are non-refundable once the listing goes live, except where a refund is required by law or where we are unable to publish your listing. Any purchase of a vehicle itself is agreed and paid for directly between the buyer and the seller, outside the app — CarGate never handles the price of a car.
6. Business Accounts
Showroom and service-provider accounts are activated as soon as you sign up and can publish their inventory and services right away, at no cost. No membership or subscription is required to run your business on CarGate. Any optional paid promotion is always shown with its price before you buy.
7. Communication and Chat
In-app chat is provided for genuine buying and selling conversations. Do not use it for spam, harassment, unsolicited advertising, or moving users to fraudulent channels. We may review reported conversations to investigate abuse and enforce these terms.
8. Prohibited Conduct and Objectionable Content
You may not: list stolen, damage-concealed, or encumbered vehicles without disclosure; misrepresent price, mileage, or condition; impersonate others; interfere with the app's operation; scrape data; or use the platform for any unlawful purpose. CarGate has zero tolerance for objectionable, offensive, abusive, hateful, sexually explicit, or otherwise illegal content, and for harassing or abusive behavior toward other users. You can report or flag any content or user, and block any user, directly in the app. We review every report and remove violating content and eject the users responsible — normally within 24 hours.
9. Intellectual Property
The CarGate name, logo, design, and software are our property. By posting content, you grant us a non-exclusive, royalty-free license to display and promote it within the platform. You retain ownership of your content.
10. Disclaimer and Liability
The app is provided “as is” without warranties of any kind. To the maximum extent permitted by law, CarGate is not liable for losses arising from transactions between users, listing inaccuracies, or service interruptions.
11. Suspension and Termination
We may suspend or permanently close accounts that violate these terms, applicable law, or the safety of our community — with or without notice. You may delete your account at any time from Settings.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be announced in the app, and continued use after a change takes effect constitutes acceptance.
13. Governing Law and Disputes
These terms are governed by the laws of the Republic of Iraq, including the applicable laws of the Kurdistan Region. Any dispute arising from your use of the app or a transaction facilitated through it will be subject to the exclusive jurisdiction of the competent courts of Iraq. Where possible we will try to resolve complaints informally through the Support Center first. Nothing in these terms removes any mandatory consumer rights you have under local law.
